This Law department Faculty Seminar will centre around a discussion of the paper "Route 66: Mutations of the Internal Market Through the Prism of Citation Networks" by EUI Law Professor Urška Šadl, Sebastiano Piccolo and Lucía López Zurita (iCourts, Copenhagen).

Abstract:

The article rethinks the mutations of the internal market from a free trade area into a maze of common policies. To shed new light on this amply-theorized and over-analysed process, it examines the patterns in the case-law of the European Court of Justice from a fresh – structural – perspective and using novel – community detection – methods. The analysis of 66 years of case-law shows a decisive turn between 2007 and 2010 in the method of integration. It points at a structural change of emphasis from the de-regulatory removal of national rules obstructing trade (free movement) to a re-regulatory approximation of national rules and standards at times tangential to free movement and without an immediate economic rationale. Finally, the article inquires whether the shift in the method of integration calls for a new justification / ‘authorisation’ of Europe to regulate.
