Securing access to critical raw materials is, from the viewpoint of the European Commission, is of a strategic importance and a necessity to ensure that the EU achieves climate neutrality by 2050. To this end, it has put forward the Critical Raw Materials Act (Act) that is currently co-decided by the Council and Parliament. In this session, we will discuss conflicts that the rally for critical minerals has created - both within and outside the EU - and consider whether the proposed Act responds to these, as well as the extent to which it creates a new set of legal issues.
